lumaa is an AI-powered fashion photography platform that enables brands and creators to generate professional product photography using artificial intelligence. Our services may include, but are not limited to, AI model generation, product image creation, pose and vibe selection, garment fitting, and campaign export tools.

3. Eligibility

You must be at least 18 years of age to use lumaa. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

4. Account Registration

Certain features of lumaa may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at help@lumaa.ai if you suspect any unauthorised use of your account.

5. Intellectual Property

All content on the lumaa website, including but not limited to images, text, graphics, logos, design, layout, software, and underlying technology, is the intellectual property of lumaa and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any part of this website without prior written permission from lumaa.

6. User Content & Uploads

When you upload product images or other content to lumaa, you retain ownership of your original content. By uploading, you grant lumaa a non-exclusive, worldwide, royalty-free licence to use, process, and transform your content solely for the purpose of delivering our services to you. You represent and warrant that you have all necessary rights to the content you upload and that such content does not infringe upon the rights of any third party.

7. AI-Generated Content

Images and other outputs created by lumaa's AI tools are generated for your use in accordance with your subscription plan. You are granted a licence to use AI-generated content for your commercial and personal purposes, subject to the terms of your plan. lumaa does not guarantee that AI-generated outputs will be free from errors, artefacts, or imperfections. You are responsible for reviewing all generated content before use.

8. Prohibited Uses

You agree not to use lumaa for any of the following:

(a) Any unlawful purpose or in violation of any applicable law or regulation.

(b) Uploading content that is obscene, defamatory, fraudulent, or that infringes on the intellectual property rights of others.

(c) Attempting to reverse-engineer, decompile, or extract the source code or underlying algorithms of lumaa's technology.

(d) Interfering with or disrupting the integrity or performance of the service.

(e) Generating content that depicts real individuals without their consent, or content intended to deceive or mislead.

9. Payments & Subscriptions

Certain lumaa features may be offered on a paid subscription basis. Pricing, billing cycles, and cancellation policies will be presented to you at the time of purchase. All fees are non-refundable unless otherwise stated. lumaa reserves the right to change pricing with reasonable notice.

10. Limitation of Liability

To the fullest extent permitted by applicable law, lumaa and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim shall not exceed the amount you have paid to lumaa in the twelve (12) months preceding the event giving rise to the claim.

11. Disclaimer of Warranties

The lumaa service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. lumaa does not warrant that the service will be uninterrupted, secure, or error-free.

12. Privacy

Your use of lumaa is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using lumaa, you consent to the practices described in our Privacy Policy.

13. Termination

lumaa reserves the right to suspend or terminate your account and access to the service at any time, with or without cause, and with or without notice. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall remain in effect.

14. Indemnification

You agree to indemnify, defend, and hold harmless lumaa and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your violation of these terms, or your infringement of any rights of a third party.

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Amsterdam, the Netherlands.

We may update these Terms and Conditions from time to time at our sole discretion. When we do, we will revise the effective date at the top of this page.
